Thank you for visiting our website, www.richdevos.com (the “Site”).

We are committed to protecting and safeguarding your privacy. The purpose of this Privacy Policy is to inform you about the types of information we might collect about you when you visit our Site, how we may use that information and whether we disclose it to anyone.

BY VISITING OUR SITE, YOU AGREE TO BE BOUND BY THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH ANY OF THE TERMS OF THIS POLICY, PLEASE DO NOT USE OUR WEBSITE OR OTHERWISE PROVIDE US WITH YOUR INFORMATION.

What Information We Collect and How We Use It

Any information we collect on our Site generally falls into the following two categories: Personally Identifiable Information and Aggregate Information. Personally Identifiable Information refers to information that lets us know who you are or things specifically about you.

A. Visitors

When you visit this Site, our servers and third party service providers may automatically record certain information about how you use the Site, such as your Internet Protocol (IP) address and DNS. We collect this information in server logs and by using cookies and similar tracking technologies.

B. Tributes

If you choose to submit a Tribute through this Site, we ask for your name, city, state or country and email address. Your email address will not be published and will only be used to communicate with you to notify you that your Tribute has been received, when your Tribute has been published and possibly for additional contact regarding your Tribute. We will not retain your email address for more than 90 days. In addition, you may leave a private Tribute for the DeVos family that will not be published to the site by sending a personal email to tributes@richdevos.com. In doing so you share your email address and any other personal information you provide such as your name, city and state/country with us.

C. Contact us

You may also contact us for help or support and provide us information and a way to contact you to address your inquiry.

D. Aggregate Information

This refers to information that does not, by itself, identify you as a specific individual. Such information would include the Uniform Resource Locator (“URL”) of the website that referred you to our Site, your operating system and browser type, any search terms that you enter on our Site, the pages or features of the Site that you browsed and the time spent on those pages or features, the frequency with which you use the Site, the links that you click on or use, and other statistics. Our web server aggregates this information in order to monitor the level of activity on our Site, evaluate its effectiveness, and improve the content of our Site in order to make your visit an easy and enjoyable experience. We may collect, compile, store, publish, promote, report, or otherwise disclose or use any Aggregate Information, provided that such information does not personally identify you. We generally do not correlate any Personally Identifiable Information with the Aggregate Information that we collect on our Site. If we do correlate any Aggregate Information to you, it will be protected like any other Personally Identifiable Information under this Privacy Policy.

Sharing Your Information

If we decide to publish your Tribute, it will be posted on this Site along with your name and the date of your submission. Otherwise, we will not sell, trade, rent, or retransmit any Personally Identifiable Information we collect online, except as noted below. Any Personally Identifiable Information you provide to us will be stored in our databases in the United States.

We may use business partners to help us design and operate our website or provide other services to support the site. When we use business partners, it will generally be on terms that prohibit them from making any independent commercial use of Personally Identifiable Information, from sharing such data with third parties, or from making the data publicly available.

We use Google Analytics to help us gather and evaluate statistical information about the visitors to our site and how they use the site on an anonymous, aggregate basis, but will not associate this data with Personally Identifiable Information unless required to do so to cooperate with law enforcement activity or other governmental request or to comply with law. We use this information to gain a better understanding of the visitors to our site and to improve our website and product offerings. Depending on the type of browser and device that you use, you may have the ability to control the type of information that Google Analytics use. To understand how Google Analytics collects and processes data, please visit Google Analytics for more information.

From time to time, we may be required to provide Personally Identifiable Information in response to court order, subpoena, or government investigation. We also reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful. We may release Personally Identifiable Information when we believe that such release is reasonably necessary to enforce or apply our Terms of Use or to protect the rights, property, and safety of others and ourselves, or when otherwise required by law. If there is a sale or merger of the company, division or business unit that operates this site, we may also transfer the information we have collected in connection with such sale or merger.

We reserve the right to license or sell aggregate information about the visitors to our website, but this information will not be individually identifiable.

Your Choices

We will generally not use or share the Personally Identifiable Information collected on our Site in ways unrelated to the purpose for which you provided the information, including those described above, without providing you a choice whether to permit any such unrelated uses. You are not required to provide all personal information identified in this Policy to use our Site or to interact with us offline, but certain functionality will not be available if you do not provide your Personally Identifiable Information.

The security of your personal information is important to us. We take a number of organizational, technical and physical measures that are designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies and we cannot guarantee the absolute security of your personal information.

A. Shine the Light.

Under California’s “Shine the Light” law, you have the right to ask us once a year if we have shared your personal information with third parties for direct marketing purposes. To make a request please contact us as instructed in the “How to Contact Us” section and specify you are making a Shine the Light request.

B. California Consumer Privacy Act (“CCPA”).

The CCPA creates consumer privacy rights and requires businesses to make disclosures about their privacy policies and practices. Pursuant to the CCPA, both our privacy practices and your privacy rights are discussed in detail in the following information.

1. Personal Information We Collect.

We collect your personal information when you interact with our Site or otherwise communicate with us. For the purposes of this Privacy Policy, “personal information” means information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device.

In the past 12 months, we have collected the following categories of personal information: identifiers (including real name, mailing address, email address, telephone numbers, and online identifiers and IP address), geolocation data, and internet or other electronic network activity information (including browsing history, search history, and information regarding an individual’s interaction with an internet site or application, or advertisement). We have used this information to respond to your requests, track original Site visits, optimize your Site experience, and ensure the Site and our systems are properly functioning.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible business purposes without providing you notice.

2. Sharing Your Information.

We do not sell your personal information, but may disclose it to third parties for a business purpose. Specifically, we may disclosure the personal information described above to our website and internet service providers, operating systems and platforms, and marketing intelligence service providers.

3. Source of Personal Information.

We obtain the categories of personal information that are listed above when you provide it to us directly and passively when you visit our Site. Please see the first section of this Privacy Policy entitled “What Information We Collect and How We Use It” for more details about the ways in which we obtain your information.

4. Your Rights.

The CCPA gives you certain rights regarding your personal information:

a. Right to Know. You may request no more than twice in a 12-month period that we provide you with copies of specific personal information we have collected, sold, or disclosed about you. However, under California law, we cannot provide you with certain sensitive information, despite your request (for example, we will not send you copies of your social security number even if it is something we collected).

b. Right to Delete. You may request that we delete certain personal information we have collected about you, with certain exceptions.

To exercise your rights above, please submit a request to us at support@richdevos.com or by calling (888) 723-2833 or by using this form. Please describe your request with sufficient detail so we can properly respond to your request. We may ask for additional information to verify your identity. The information you provide in your request and any follow up information we ask for from you will be used solely to verify your request. After receiving your request, we may need to contact you for further information and will notify you if your request has been granted or declined, or if an exception applies to your request. Only you or an individual designated as your authorized agent to act on your behalf may make a request related to your personal information. We may not discriminate against you if you choose to exercise your rights.

5. Responding to Your Rights Request.

We will try to respond to your request within 45 days. If we need more time, we will contact you with the reason we need more time and the extension period. We will deliver our written response by mail or electronically, at your option. In response to your request to know, we will only disclose the information we have collected in the 12 months prior to our receipt of your request. Our response will also explain the reasons we cannot comply with any request, if applicable. We do not charge a fee to process or respond to your request unless your request is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate prior to completing your request.
